Terms of Service
Please read carefully before using the SecureSS VPN service

These Terms of Service (hereinafter "Terms") set forth the conditions for using the VPN service "SecureSS" (hereinafter "Service") provided by SecureSS (hereinafter "Company"). By subscribing to the Service, you agree to these Terms.
Article 1 (General Provisions)
- These Terms apply to all relationships between the Company and users of the Service (hereinafter "Users").
- The Company may establish additional terms of use (hereinafter "Supplementary Terms") in addition to these Terms, and such Supplementary Terms shall constitute a part of these Terms.
- In the event of any conflict between these Terms and Supplementary Terms, the Supplementary Terms shall prevail.
Article 2 (Service Description)
- The Service is an encrypted communication service (VPN) using the Shadowsocks protocol.
- The Service provides internet traffic encryption through servers located in Japan.
- The content, specifications, and conditions of the Service may be changed without prior notice at the Company's discretion.
- The Service does not guarantee access to specific websites, video streaming services, or other online services. Some services, such as Japan-exclusive video content, may not be accessible.
- Connection speed and quality are provided on a best-effort basis and are not guaranteed.
Article 3 (Formation of Service Agreement)
- The service agreement is formed when the User applies through the method designated by the Company and the Company accepts the application.
- Users are obligated to provide accurate information at the time of application.
- Users must be 18 years of age or older.
- The Company may decline an application in the following cases:
- If the application contains false information
- If the applicant has previously violated these Terms
- If the Company deems it inappropriate for other reasons
Article 4 (Account Management)
- Users shall manage the Service connection details (server address, port number, password, etc.) at their own responsibility.
- Transfer, lending, sharing, selling, or publishing of connection details to third parties is prohibited. However, use within the same household is permitted.
- The Company bears no responsibility for damages arising from unauthorized use of connection details.
Article 5 (Service Fees & Payment)
- Service fees shall be in accordance with the fee schedule separately determined by the Company.
- Payment shall be made via Stripe (credit card, Apple Pay, Google Pay, etc.).
- Service fees are prepaid, and the full amount for the selected plan period shall be paid in a lump sum.
- The Company may change fees with prior notice. Changed fees will be applied from the next renewal.
Article 6 (Free Trial Period)
- New Users are provided with a 5-day free trial period.
- If cancelled during the free trial period, no charges will apply.
- After the free trial period ends, the selected plan fee will be charged automatically.
- Abuse of the free trial period (repeated sign-up and cancellation, etc.) is prohibited.
Article 7 (Refund Policy)
- Due to the nature of the Service, refunds after payment are generally not accepted.
- If the Service is unavailable for an extended period (7 or more consecutive days) due to reasons attributable to the Company, the Company will extend the service period by an equivalent duration.
- Service unavailability due to factors beyond the Company's control, such as regulatory changes in the destination country, government blocking, ISP failures, or natural disasters, is not eligible for refunds.
Article 8 (Prohibited Activities)
Users shall not engage in the following activities when using the Service:
- Activities that violate laws or public morals
- Criminal activities or activities that may lead to crime
- Activities that violate the laws of the destination country
- Activities that infringe on copyrights, trademarks, portrait rights, privacy rights, or other intellectual property rights
- Cyber attacks such as unauthorized access, DDoS attacks, malware distribution, or port scanning
- Sending spam emails or phishing
- Illegal file sharing using P2P software such as BitTorrent or Winny
- Reselling, redistributing, or publishing the Service connection details to third parties
- Reverse engineering, decompiling, or analyzing the Service
- Defamation, slander, threats, or harassment against other Users or third parties
- Activities that place excessive load on the Company's servers or network
- Abuse of the free trial period (repeated sign-up and cancellation, etc.)
- Any other activities deemed inappropriate by the Company
Article 9 (Service Suspension & Interruption)
- The Company may temporarily suspend or interrupt the Service in the following cases:
- Maintenance or inspection of servers and network equipment
- Server or communication failures
- Force majeure events such as natural disasters, power outages, war, or terrorism
- Other cases deemed necessary by the Company
- For planned maintenance, the Company will make efforts to provide advance notice.
- The Company is not liable for damages incurred by Users due to temporary suspension or interruption of the Service.
Article 10 (Service Termination & Forced Cancellation)
- If a User violates these Terms, the Company may suspend the Service or terminate the service agreement without prior notice.
- In such cases, no refund of fees already paid will be made.
Article 11 (Disclaimer)
- The Service is provided "as-is." The Company makes no warranties regarding the completeness, accuracy, reliability, or usefulness of the Service.
- The Company does not guarantee access to specific websites, applications, or services.
- Connection speed, stability, and latency are not guaranteed.
- The Company bears no responsibility for disputes arising between Users and third parties resulting from the use of the Service.
- The Company is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the Service, regardless of foreseeability.
Article 12 (Liability for Damages)
- If the Company is liable for damages to a User, the maximum amount shall be limited to the most recent one month's service fee paid by the User to the Company.
- The right to claim damages shall expire if not exercised within one year from the occurrence of damages.
Article 13 (Privacy & Log Policy)
- The Company does not log Users' communication content, browsing history, or destination IP addresses.
- Information collected by the Company is limited to the following:
- Name and email address (for account management)
- Payment information (for payment processing through Stripe; the Company does not directly store credit card numbers)
- Anonymous aggregate traffic statistics (for service quality improvement)
- The Company will not provide Users' personal information to third parties except as required by law.
- If requested by law enforcement, information may be disclosed in accordance with applicable laws. However, as stated above, no communication content logs are retained, so the information that can be disclosed is limited.
Article 14 (Intellectual Property Rights)
- Copyrights, trademarks, and other intellectual property rights related to the Service belong to the Company.
- Users may not reproduce, distribute, transmit, or repost the Service content without the Company's prior written consent.
Article 15 (Cancellation & Account Deletion)
- Users can cancel and delete their account at any time by entering their email address and port number on the cancellation page and clicking the cancel button in the confirmation email.
- No cancellation fees will be charged.
- Upon completion of the cancellation procedure, use of the Service will be immediately terminated. Even if there is remaining service time, the Service cannot be used.
- No refunds will be made after cancellation.
- Account information will be promptly deleted after cancellation.
Article 16 (Changes to Terms)
- The Company may change these Terms when deemed necessary.
- The revised Terms shall take effect upon publication on the Service website.
- For significant changes, the Company will make efforts to notify Users by email or other means.
- If a User continues to use the Service after a change in Terms, the User is deemed to have agreed to the revised Terms.
Article 17 (Governing Law & Jurisdiction)
- These Terms shall be governed by the laws of Japan.
- Any disputes related to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
